ISLAMABAD: The Islamabad High Court (IHC) on Friday directed to produce all four children in a family dispute related to the custody of kids.
Hearing the application of the mother of the children, Justice Mohsin Akhtar Kayani remarked that disputes can occur between husband and wife, but they should not be turned into a fight between parents.
The husband and wife appeared in the court along with their respective lawyers.
The court directed all the children to be presented in the court at the next hearing and remarked that the children cannot be divided.
During the hearing, the court inquired about the number and ages of the children, to which the lawyer of the petitioner said that there are four children aged between 4 and a half years and 12 and a half including two sons and two daughters. One younger son is with the woman, while three children are with the father.
When the court asked the couple about the separation, both of them stated that neither they have separated nor do they wanted to, to which the court remarked in that case why they are living apart for the last four years? The husband said he neither wanted separation nor has remarried, however, the wife demands that the house be transferred to her name.
To this, Justice Mohsin Akhtar Kayani said transferring the house on wife’s name is not a big deal, he has also transferred his property to his wife.
The court remarked that judges and lawyers are enemies of the couple and the children and cannot resolve the issue that the couple could not resolve among themselves.
The court directed them to sit down and resolve the issue, learn to apologize and forgive, if one gets angry, the other should show patience. The court said that it is a woman’s courage to leave her parents and live with her husband, besides this is a critical time for the upbringing of children. In a few years, the children will grow up and both the parents may have to bear the consequences of this situation.
Upon court inquiry, both the husband and wife agreed to apologise to each other, upon which the court directed them to sit together in the courtroom.
The Islamabad High Court ordered the four children to be produced in court at the next hearing and adjourned the hearing of the case till next Friday.
